CITY OF BUCHANAN

MINUTES OF COUNCIL MEETING 

April 19, 2011 

Attendance:  Mayor:  Benjamin Biggers.

Council Members:  Benjamin Westmoreland, Kenny Hughes, McKinley Pate, Patricia Warren.  

Department Heads: City Clerk Karen King, Public Works Director Dean Tanner, Police Chief Tracy Lambert. 

Mayor Pro Tem Hughes: called the meeting to order at 6:30 p.m. 

Mayor Pro Tem Hughes welcomed everyone. 

Mayor Pro Tem Hughes leads Pledge of Allegiance. 

Mayor Pro Tem Hughes asks to accept the agenda for tonight.  Benjamin Westmoreland made a motion to accept the agenda.   Patricia Warren seconded the motion.  Motion carried 3-0. 

Mayor Pro Tem Hughes asks to accept the minutes from March 8, 2011 council meeting Work Session April 5, 2011.  Patricia Warren made a motion to accept minutes.  Benjamin Westmoreland seconded the motion.  Motion carried 3-0.   

Public Participation: 

Mayor Pro Tem Hughes asks Jana Gentry to come forward.  Explains events scheduled for library for May and upcoming summer events to mayor and council.  

New Business: 

Appalachian Valley Fiber Network representative Jerry Shearin asks mayor and council to sign franchise agreement with Appalachian Valley Fiber Network. 

Mayor Biggers asks to sign franchise agreement with Appalachian Valley Fiber Network.  Kenny Hughes made a motion to sign franchise agreement with Appalachian Valley Fiber Network.  McKinley Pate seconded the motion.  Motion carried 4-0.   

 Mayor Biggers asks for motion to go into executive session for personnel matter.  Kenny Hughes made a motion to go into executive session.  Benjamin Westmoreland seconded the motion.  Motion carried 4-0.   

Mayor Biggers asks for motion to come out of executive session.  McKinley Pate made a motion to come out of executive session.  Patricia Warren seconded the motion.  Motion carried 4-0.   

Mayor Biggers asks if there is a motion regarding executive session.  McKinley Pate makes a motion to take Police Chief Tracy Lambert off probation effective immediately.  Benjamin Westmoreland seconded the motion.  Motion carried 4-0. 

Mayor Biggers asks council member McKinley Pate to read a letter that he had prepared and give to mayor and council. 

McKinley Pate states that effective August 12, 2011 he will be resigning his post as council member and moving his family to Memphis TN. 

Department Updates: 

Mayor Biggers asks for the department updates: 

Public Works Director Dean Tanner:  

(1.)  Explains Tallapoosa Street will get partially paved using state funding.  Further explains we cannot at this time afford to spend what it would take to finish the job however he could work with the state to get some patching done for around twelve hundred dollars. 

Mayor Biggers explains that Kenny Hughes chooses to abstain from this vote because he lives on Tallapoosa Street. 

Mayor Biggers asks if there is a motion to allow Public Works Director Dean Tanner to patch Tallapoosa Street.  Benjamin Westmoreland makes a motion to allow Public Works Director Dean Tanner to patch Tallapoosa Street.  Patricia Warren seconded the motion.  Motion carried 3-0. 

 Police Chief Tracy Lambert  

(1.)  Asks mayor and council for a motion to hire Heath Williams part time. (2.)  Asks mayor and council to remove the line item fire truck repair from general fund and add it to police department with budget and allow him to monitor the expenditures.  (3.)  Asks for motion from mayor and council regarding 107 Highland Avenue property taking title for this property in lieu of taxes and the City of Buchanan doing the clean up. (4.)  States to mayor and council that he appreciates being taken off probation. 

Mayor Biggers asks if there is a motion to allow Police Chief Tracy Lambert to hire Heath Williams part time.  Benjamin Westmoreland makes a motion to allow Police Chief Tracy Lambert to hire Heath Williams part time.  Kenny Hughes seconded the motion.  McKinley Pate votes no.  Motion carried 3-1.

Mayor Biggers asks if there is a motion to accept title to 107 Highland Avenue in Lieu of taxes.  Benjamin Westmoreland makes a motion to accept title to 107 Highland Avenue in Lieu of taxes.  Patricia Warren seconded the motion.  Motion carried 4-0. 

City Clerk Karen King:  

(1.)  Presents mayor and council with documents from GMA.  (2.)  Explains to mayor and council that Diane Williams has asked that city wide yard sale be same day as fair on square.  Mayor and council do not think this a good idea and refuse request.  (3.)  Reads letter from Department of Labor.  (4.)  Explains state SAVE program to mayor and council. 

Mayor Biggers asks for a motion to adjourn.  Patricia Warren makes motion to adjourn.  Benjamin Westmoreland seconded motion.  Motion carried 4-0.
