CITY OF BUCHANAN

MINUTES OF COUNCIL MEETING

 November 10, 2009

 Attendance:  Mayor:  Benjamin Biggers.

Council Members:  Debbie Johnson, Donna Johnson Benjamin Westmoreland, Patricia Cook.

 Department Heads:  City Clerk Karen King, Public Works Director Dean Tanner, Police Chief Paul Pike.

Mayor Biggers: called the meeting to order at 5:30 p.m.

 Mayor Biggers welcomed everyone.

 Mayor Biggers asks Henry Bedford to lead Pledge of Allegiance.

 Mayor Biggers asks Benjamin Westmoreland to give invocation.

Mayor Biggers asks to accept the agenda for tonight.  Donna Johnson made a motion to accept the agenda with change of wording from work session to council meeting.  Debbie Johnson seconded the motion.  Motion carried 4-0.

 Mayor Biggers asks to accept the minutes from October 13, 2009.  Donna Johnson made a motion to accept the minutes with changes.  Debbie Johnson seconded the motion.  Benjamin Westmoreland opposed the motion.  Motion carried 4-0. 

 Mayor Biggers asks to accept the minutes from September 8, 23, and 29 2009, also work session of September 29, 2009.  Debbie Johnson made a motion to accept the minutes.  Donna Johnson seconded the motion.  Benjamin Westmoreland opposed the motion.  Motion carried 3-0. 

 Public Participation:

 Mayor Biggers asks Michael Wallace to come forward.  Explains Liberty Christian Church Ministries is a non-profit organization that will not receive grant money this year.  Explains Liberty Christian Church Ministries helps Buchanan Community by distributing food and helping lower income families with utility bills. Requests Liberty Christian Church Ministries be allowed to receive a business license so that Liberty Christian Church Ministries may sell food in order to raise money.

 Mayor Biggers asks to allow Liberty Christian Church Ministries to receive a business license when approved by Buchanan Health Department and City Clerk Karen King.  Donna Johnson made a motion to allow Liberty Christian Church Ministries to receive a business license when approved by Buchanan Health Department and City Clerk Karen King.  Debbie Johnson seconded the motion.  Motion carried 4-0. 

 Mayor Biggers asks Bill Hightower to come forward.  Explains he has purchased property (200 Van Wert Street) from Phil Richards.  Explains he has paid past due taxes and removed burnt home.  Presents mayor and council plans for building sleeping quarters for Ambucare.  Asks mayor and council to rezone (200 Van Wert Street) from R1 to C1.

 Mayor Biggers asks City Attorney Rob Monroe to come forward.  Explains application process to rezone (200 Van Wert Street) began on October 21, 2009.  Explains ad ran in Gateway Beacon and Tallapoosa Journal on October 29, 2009 indicating that the first reading of the rezoning ordinance would be November 10, 2009.  Explains public hearing on rezoning ordinance will be November 24, 2009. 

 Mayor Biggers asks Joel Agan (Haralson Enterprise) to come forward.  Joel Agan is not present.

 Mayor Biggers explains that Jana Gentry could not attend meeting because her son had an accident.  Explains that Jana Gentry asked that he report Buchanan Library is still in business.

Department Updates:

Public Works Director Dean Tanner:

 Presents mayor and council with water loss calculation sheet for last month. 

 Police Chief Paul Pike

 Presents mayor and council with S.P.L.O.S.T. request (used cars, car equipment, tazer guns, color printers, awning, projector, walkie talkies, and shelves).

 Mayor Biggers asks to allow Police Chief Paul Pike to purchase used cars, car equipment, projector, walkie talkies, shelves, and color printers with S.P.L.O.S.T. funds the agenda for tonight.  Donna Johnson made a motion to allow Police Chief Paul Pike to purchase used cars, car equipment, projector, walkie talkies, shelves, and color printers with S.P.L.O.S.T. funds.  Debbie Johnson seconded the motion.  Motion carried 4-0.

 City Clerk Karen King:

 Explains she has paper work for the newly elected council members to fill out so they can attend their class. 

NEW BUSINESS

Mayor Biggers introduces newly elected council members who will take office in January 2010. (Kenny Hughes, Mckinley Pate)

 Mayor Biggers states that tomorrow is Veterans day and suggests that any Veteran seen on that day should be thank for getting us thus far.  Asks all Veterans to stand and asks for a round of applause for the Veterans.

 Mayor Biggers asks for a motion to go into executive session.  Debbie Johnson makes motion to go into executive session.  Donna Johnson seconded motion.  Motion carried 4-0.

 Mayor Biggers asks for a motion to come out of executive session.  Donna Johnson makes motion to come out of executive session.  Benjamin Westmoreland seconded motion.  Motion carried 4-0.
