CITY OF BUCHANAN

MINUTES OF COUNCIL MEETING

September 8, 2009

Attendance:  Mayor:  Benjamin Biggers.

Council Members:  Debbie Johnson, Benjamin Westmoreland, Patricia Cook.

Department Heads:  City Clerk Karen King.

Mayor Biggers: called the meeting to order at 5:30 p.m.

Mayor Biggers welcomed everyone.

Mayor Biggers asks Robert Farmer to lead Pledge of Allegiance.

Mayor Biggers asks Benjamin Westmoreland to give invocation.

Mayor Biggers asks to accept the agenda for tonight.  Debbie Johnson made a motion to accept the agenda with change from work session to council meeting.  Benjamin Westmoreland seconded the motion.  Motion carried 3-0.

Mayor Biggers asks to accept the agenda with addition of first reading of ordinances that will eliminate planning commission.  Debbie Johnson made a motion to accept the agenda with change from work session to council meeting.  Benjamin Westmoreland seconded the motion.  Motion carried 3-0.

Mayor Biggers asks to accept the minutes from August 11, and August 25, 2009.  Benjamin Westmoreland made a motion to accept the minutes with changes.  Patricia Cook seconded the motion.  Motion carried 3-0. 

Public Participation:

Mayor Biggers asks Michael Wallace from Liberty Christian Outreach to come forward.  Explains that Liberty Christian Outreach would like to have a candidate forum and call all the candidates together for a question and answer forum at City Hall.  Explains that Liberty Christian Outreach would like to use City Hall as distribution center for holiday (Thanksgiving and Christmas) dinner for needy. 

Mayor Biggers asks for a motion to hold candidate question and answer forum at City Hall.  Debbie Johnson made a motion to hold candidate question and answer forum at City Hall.  Patricia Cook seconded the motion.  Motion carried 3-0. 

Mayor Biggers asks to allow Liberty Christian Outreach to use City Hall as a distribution center for holiday (Thanksgiving and Christmas) dinner for needy.  Debbie Johnson made a motion to allow Liberty Christian Outreach to use City Hall as a distribution center for holiday (Thanksgiving and Christmas) dinner for needy.  Benjamin Westmoreland seconded the motion.  Motion carried 3-0. 

Mayor Biggers asks Debra Bright to come forward.  Explains past and ongoing complaints for the people of Westmoreland Subdivision.

Mayor Biggers asks Mr. Kim (Sonoco) to come forward.  Explains he would like to open a Taco Mac restaurant.  City attorney Rob Monroe explains application process to Mr. Kim and advises Mr. Kim that he should follow the application process for serving beer and wine. City Attorney Rob Monroe explains he is unsure how long the process will take so Mr. Kim should get with City Clerk Karen King.

Mayor Biggers asks Helen Wilson to come forward.  Explains she is speaking on behalf of VFW Park.  Explains the VFW Park recently had to apply to State of Georgia for Beer and Wine License.  Explains the VFW Park believed that it resided on County property and has since found out that it resides on City property.  Explains the VFW Park is a non-profit organization and does not pay taxes.  Explains the VFW Park is requesting to be de-annexed from City limits.  City Attorney Rob Monroe explains to Helen Wilson that there is a process for de-annexation and offers to give her instructions and paperwork to start the process.

Mayor Biggers asks City Attorney Rob Monroe to come forward.  Presents mayor and council with a series of ordinances that will eliminate any reference in our current zoning ordinance to the planning commission since a planning commission was never formed thereby placing all zoning issues in the hands of the mayor and council.  City Attorney Rob Monroe explains this is the first of two readings of the above mentioned ordinances.  City Attorney Rob Monroe opens the floor for public comment and concern regarding the above mentioned ordinances.  John Norton explains his concern for placing zoning in the mayor and councils hands.  City Attorney Rob Monroe explains that a planning commission would simply be making recommendations and all decisions would fall to mayor and council regardless.  John Norton withdraws his concern.  City Attorney Rob Monroe explains that this is the second reading of an ordinance that will allow Joe Kelly  Annexation, zoning and conditional use of his property into City limits.  Joe Kelly explains senior facility and strip mall he will be building on his property.  City Attorney Rob Monroe closes public participation.

Mayor Biggers asks for a motion to Annex Joe Kelly property into City limits and zone  C1 conditional use requirement.  Debbie Johnson makes a motion to Annex Joe Kelly property into City limits and zone C1 conditional use requirement.  Benjamin Westmoreland seconded motion.  Motion carried 3-0. 

Mayor Biggers asks Jana Gentry to come forward.  Jana Gentry could not attend.

Department Updates:

Mayor Biggers asks for the department updates:

Public Works Director Dean Tanner:

(1.) Explains the anti-degradation report is now complete.  (2.) Explains water loss for August.  (3.) Explains Van Wert will be paved using the LARP program this year.  (4.)  Explains that Dobbs has not started on Westmoreland lift station yet but he will be checking to find out when he will start the job.

Detective Paul Pike for Police Chief Judy Parrish:

(1.)  Explains that Darlene Smith is well and will return soon.  (2.)  Explains reasons why police department should not be cut, provides mayor and council with documentation of all aspects of police department.    

City Clerk Karen King:

(1.)  Explains that she will be asking for a called meeting on September 15th to set millage rate and adopt budget.

NEW BUSINESS

LIQUOR REFERENDUM:

Mayor Biggers asks for motion to adopt liquor referendum.  Debbie Johnson makes a motion to adopt liquor referendum.  Patricia Cook seconded motion.  Benjamin Westmorland votes no.  City Attorney advises council that it will require 3 yes votes and since Donna Johnson is not in attendance the vote will be tabled until called meeting.

COST OF CITY PERMITS/INSPECTOR:

City Clerk Karen King explains that the City of Buchanan is not making much money and after January 1, 2010 City of Buchanan will have to hire a new inspector since Inspector Mark Moore will be leaving at the end of December.

City Attorney Rob Monroe explains actions that the City of Cedartown takes against violators.
